Terms of Service

1. Service Description
Security Binder is a web-based application that helps organizations build compliance plans, security policies, and internal assessments through guided wizards and professional document export. The service provides structured documentation workflows, questionnaires, and frameworks. It does not provide legal, regulatory, audit, insurance, or professional compliance advice, and it does not guarantee compliance, certification, audit acceptance, or insurer acceptance. Exported documents are review-ready drafts that you must review, complete, and approve — with an internal owner and qualified legal or compliance counsel as appropriate — before operational use. Security Binder is operated by NonaSec LLC.
2. Account Terms
- You must provide a valid email address to create an account.
- You are responsible for maintaining the security of your account credentials.
- One person or organization may not maintain more than one free account.
- You must be at least 18 years old to use the service.
- You are responsible for all content and activity under your account.
3. Subscription & Payment
- Free accounts include limited plan creation and preview capabilities.
- Paid plans (Pro and Business) are billed monthly via Stripe.
- You may cancel your subscription at any time. Access continues through the end of the current billing period.
- Tier limits (documents, assessments, frameworks, team seats, and feature availability) are enforced based on your subscription tier.
- We reserve the right to change pricing with 30 days' notice to active subscribers.
4. Acceptable Use
You agree not to:
- Use the service for any unlawful purpose or to violate any regulations.
- Attempt to gain unauthorized access to other accounts or systems.
- Reverse engineer, decompile, or disassemble the service.
- Use automated systems (bots, scrapers) to access the service without permission.
- Resell, redistribute, or sublicense access to the service.
5. Your Content
You retain ownership of all content you create within Security Binder, including plan answers, scoping data, and exported documents. We do not claim ownership of your content.
You grant us a limited license to store, process, and display your content solely to provide the service. We do not use your content to train machine learning models or share it with third parties beyond what is necessary to operate the service.
6. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect availability. We will provide reasonable notice for planned downtime when possible.
7. Limitation of Liability
Security Binder is provided “as is” without warranty of any kind. The service provides guided compliance documentation and general guidance, not legal, regulatory, or audit advice. You are solely responsible for ensuring your compliance plans meet your organization's regulatory requirements.
To the maximum extent permitted by law, Security Binder shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, business interruption, or regulatory penalties.
8. Termination
You may close your account at any time. We may suspend or terminate accounts that violate these terms. Upon termination, your data will be handled according to our Privacy Policy.
9. Changes to Terms
We may modify these terms at any time. Material changes will be communicated via email at least 30 days before taking effect. Continued use after changes constitutes acceptance.
10. Cyber Insurance Readiness Assessment
The Cyber Insurance Readiness Assessment is an internal readiness worksheet and documentation checklist. It helps you map controls to common questionnaire themes and identify gaps before you work with a licensed broker or carrier. Security Binder does not sell insurance, submit applications on your behalf, guarantee coverage or premium outcomes, or provide legal or brokerage advice.
You are solely responsible for the accuracy of statements on any cyber insurance application or renewal questionnaire. Material misrepresentation (overstating controls or failing to disclose known incidents) can affect coverage after a loss, including potential rescission. Review exported draft answers against your actual operating environment before submitting any carrier form.
